Timeline for Exclusions

 

Day 0

Head Teacher Excludes pupils and immediately writes to Parents including details on length of exclusion, reason for exclusion and rights of representation.

  • If the exclusion is to start the next morning before the next morning
  • If the exclusion is to start immediately either  before the afternoon sessions or the end of the day depending on what time the exclusion took place

 

If the Exclusion is for less than 6 days in any one term

  • Head teacher does not have to inform the Governing Body unless an external exam would be missed or the total number of days of exclusion in any term exceed 5 days AND the parents ask for a meeting
  • School has to set and mark work for the pupil at home
  • Reintegration Meeting  should be arranged for primary aged pupils

 

If the Exclusion is for between 6 and 15 days in any one term

  • Head Teacher must inform the Governing Body and LA
  • Governing Body must convene a meeting only if an external exam would be missed, the total number of days excluded in the term exceeds 15 days OR the parent requests it. Meeting must be held between the 6th and 50th day following notice of exclusion
  • Parents may make written representations and/or attend the meeting
  • Reintegration Meeting  should be arranged
  • School to set and mark work for the first 5 days
  • School to arrange appropriate full time education from day 6

 

If the Exclusion is for more than 45 days in any one Year

  • Exclusion becomes a Permanent Exclusion

 

If the Exclusion is Permanent

  • Head Teacher must inform the Governing Body
  • School to set and mark work for the first 5 days
  • LA to arrange appropriate full time education from day 6
  • Governing Body must meet within 15 school days of being informed of the Exclusion
  • Parents and the child can make written representations and/or attend the meeting
  • Governing body can uphold the Head’s decision to exclude or overturn the decision and decide whether or not to reinstate the pupil
  • If Governors Uphold the Head’s decision to Permanenently Exclude the parents have the right of appeal to the Independent Appeal Panel

 

If a Public Examination is missed

  • Within one school day the head teacher/ teacher in charge must inform the governing body/management committee and the LA of any exclusion which would result in the pupilmissing a public examination
  • If any exclusion would result in the pupil missing a public examination, the governing body/management committee should try to meet before the date of the examination
  • If, exceptionally, it is not practical for the governing body/management committee to meet before the time when the pupil is due to take the public examination, the Chair of Governors/Chair of the management committee – using his or her powers to act in an emergency – may consider the exclusion and decide whether or not to reinstate the pupil (these are the only circumstances in which the Chair of Governors or the Chair of the management committee can alone review an exclusion)
